Privacy Policy for the Zevij Necomij Mobile Academy App

Zevij Necomij, (“Respon­si­ble Par­ty”) here­by informs you about the data pro­tec­tion reg­u­la­tions accord­ing to the Data Pro­tec­tion Reg­u­la­tion (“DSGVO”) and the Data Pro­tec­tion Act (“DSG”) in con­nec­tion with the use of the Zevij Necomij Mobile Acad­e­my App (“App”). You are wel­come to address any ques­tions to us via the con­tact details at the end of this statement.

1. terms

Per­son­al data is any data con­tain­ing infor­ma­tion about per­son­al or fac­tu­al cir­cum­stances, for exam­ple, name, address, email address, tele­phone num­ber, date of birth, age, gen­der, nation­al insur­ance num­ber, video record­ings, pho­tographs, etc., relat­ing to an iden­ti­fied or iden­ti­fi­able nat­ur­al person

To the extent that there are any changes to your per­son­al data, please noti­fy us accordingly. 

2. purposes and legal basis

We col­lect, process and use your per­son­al data only if this is nec­es­sary for the ful­fil­ment of a con­tract or due to a legal oblig­a­tion or if you pro­vide us with this data vol­un­tar­i­ly. We will obtain your con­sent in advance for any fur­ther pro­cess­ing. If our legit­i­mate inter­est in data pro­cess­ing out­weighs your inter­est in data pro­tec­tion, pro­cess­ing may also take place with­out your consent. 

The data will be used for the pur­pose of offer­ing the app and track­ing the progress of the train­ing. We will also use the data pro­vid­ed to us in par­tic­u­lar for the pur­pose of ini­ti­at­ing and ful­fill­ing con­tracts and meet­ing legal obligations. 

We inform you that the pro­vi­sion of per­son­al data is part­ly required by law (e.g. tax reg­u­la­tions) or may also result from con­trac­tu­al reg­u­la­tions (e.g. details of the con­trac­tu­al part­ner). Fail­ure to pro­vide per­son­al data would mean that the ser­vices could not be provided.

3. processed data

The fol­low­ing per­son­al data is nec­es­sary to use the app:

  • First name, last name
  • Posi­tion
  • Con­tact details (email address)
  • Any date of birth, com­pa­ny number

4. your rights

You have the right to infor­ma­tion about your stored per­son­al data, as well as a right to cor­rec­tion, data trans­fer, objec­tion, restric­tion of pro­cess­ing, and block­ing or dele­tion of incor­rect or inad­mis­si­bly processed data with­in the frame­work of the pro­vi­sions of the DSGVO. 

You have the right to with­draw con­sent at any time with­out affect­ing the law­ful­ness of the pro­cess­ing until the with­draw­al of con­sent. Our con­tact details for with­draw­ing con­sent can be found at the end of this pri­va­cy policy.

If you are of the opin­ion that the pro­cess­ing of your per­son­al data by us vio­lates applic­a­ble data pro­tec­tion law, you have the pos­si­bil­i­ty to com­plain to the com­pe­tent super­vi­so­ry author­i­ty. In Aus­tria, the com­pe­tent author­i­ty is the Data Pro­tec­tion Author­i­ty, Barich­gasse 40–42, 1030 Vien­na, tele­phone: +43 1 521 52–25 69, e‑mail: dsb@dsb.gv.at.

5. data security measures

Your per­son­al data is pro­tect­ed by appro­pri­ate organ­i­sa­tion­al and tech­ni­cal pre­cau­tions. These pre­cau­tions relate in par­tic­u­lar to pro­tec­tion against unau­tho­rised, ille­gal or acci­den­tal access, loss, pro­cess­ing, use and manipulation.

Please note that we do not accept any lia­bil­i­ty what­so­ev­er for the dis­clo­sure of infor­ma­tion due to errors in data trans­mis­sion not caused by us and/or unau­tho­rised access by third parties.

6. transmission of data to third parties

In order to ful­fil our con­trac­tu­al or legal oblig­a­tions and to offer the App, it is nec­es­sary to trans­fer your data to order proces­sors or oth­er recip­i­ents due to our legit­i­mate inter­ests (Art 6 para 1 lit f DSGVO). Proces­sors process your per­son­al data in accor­dance with instruc­tions and only to the extent nec­es­sary for the per­for­mance of these tasks. Our proces­sors are, for exam­ple, exter­nal IT ser­vice companies.

The app is devel­oped and oper­at­ed by our proces­sor Insti­tute of Micro­train­ing Per­son­alen­twick­lung GmbH, FN 344584t Lan­des­gericht Inns­bruck, Maria-There­sien-Straße 16, 6020 Inns­bruck, Tel.: +43 (0) 512 27 95 20, Fax: + 43 (0) 512 58 06 77, office@micro-training.com. . In order for the app to func­tion, it is there­fore nec­es­sary for the proces­sor to process per­son­al data. The data pro­tec­tion dec­la­ra­tion of the proces­sor can be found at http://micro-training.at/datenschutz/.

We only trans­fer your data to oth­er recip­i­ents if you have either giv­en us or the recip­i­ent your con­sent to the trans­fer of data, the trans­fer of data is nec­es­sary for the con­clu­sion or ful­fil­ment of the con­tract, or we are legal­ly oblig­ed to trans­fer data.

We do not trans­fer your per­son­al data to recip­i­ents out­side the Euro­pean Union or to inter­na­tion­al organisations.

7. storage of data

We store your data for as long as is nec­es­sary to ful­fil our con­trac­tu­al or legal oblig­a­tions. For exam­ple, we are oblig­ed to keep our account­ing records for a peri­od of 7 years from the end of the rel­e­vant cal­en­dar year. When stor­ing your data, we will ensure that your data is only used to the extent nec­es­sary for the afore­men­tioned purposes

If you have giv­en us your con­sent, we will store your data for as long as spec­i­fied in your con­sent or until your con­sent is revoked.

In addi­tion, we will store your data for as long as is nec­es­sary to defend against lia­bil­i­ty or oth­er claims with­in the frame­work of the statu­to­ry lim­i­ta­tion peri­ods. Under Aus­tri­an law, these are gen­er­al­ly 3 years from the date of knowl­edge of the dam­age and the dam­ag­ing party.

Our oblig­a­tions to delete in the event that you exer­cise your right to dele­tion in accor­dance with Art 17 DSGVO are not affect­ed by the above paragraphs.

8. App Berechtigungen

  • read the con­tents of your USB stor­age, mod­i­fy or delete the con­tents of your USB storage
    The con­tents offered in the app are also avail­able offline. Autho­ri­sa­tion is required to save, delete, mod­i­fy and read the data..
  • take pic­tures and videos
    In order to log in to the app using the QR code, access to the cam­era of the end device is required.
  • view net­work con­nec­tions, receive data from Interne, full net­work access
    Par­tial inter­net access is required for the app to func­tion. This autho­ri­sa­tion can be used to check whether an Inter­net con­nec­tion exists. To down­load app con­tent and assign learn­ing progress to a spe­cif­ic user, access to the serv­er is required.
  • cre­ate accounts and set pass­words, read sync set­tings, tog­gle sync on and off
    In order to syn­chro­nise con­tent even when the app is not open, a sync account is cre­at­ed and changed by the app.
  • con­trol vibration
    To send the user noti­fi­ca­tions with vibra­tion alerts, this per­mis­sion is required.
  • pre­vent device from sleeping
    In order to play videos undis­turbed, the auto­mat­ic stand­by of the end device is deac­ti­vat­ed dur­ing this time.
